Overview

These Terms of Service govern your use of NutrientOS, a nutrition, fitness, and wellness tracking app. By creating an account or using the app, you agree to these terms and our Privacy Policy.

Health And Nutrition Disclaimer

NutrientOS provides informational nutrition and fitness estimates only. The app does not provide medical advice, diagnosis, treatment, or emergency support. Always use your own judgment and consult a qualified healthcare professional before making medical, dietary, supplement, or exercise decisions.

Body composition estimates are visual estimates only and are not medical measurements. NutrientOS does not replace DEXA scans, BodPod testing, clinical assessment, lab testing, or professional evaluation. Results may be inaccurate and should not be used to diagnose, treat, or monitor any medical condition.

Eligibility

You must be at least 16 years old to use NutrientOS, and you must be old enough to form a binding contract or have the consent of a parent or legal guardian. By using the app you represent that you meet these requirements and that the information you provide is accurate.

Accounts

You are responsible for keeping your login credentials secure and for the activity that happens under your account. You must provide accurate information and use the app only for lawful purposes.

AI Features

Food scans, body composition estimates, coach answers, recipes, and other AI-generated outputs may be incomplete, inaccurate, or based on estimates. You are responsible for reviewing and correcting any results before relying on them.

Subscriptions And Purchases

NutrientOS Pro Monthly and NutrientOS Premium Monthly are optional auto-renewable monthly subscriptions for NutrientOS nutrition, fitness, and wellness features. The subscription title, monthly length, price, and included usage limits are shown in the app before purchase. Payment is charged to your Apple Account or Google Play account after purchase confirmation.

Subscriptions renew monthly unless canceled at least 24 hours before the end of the current period. Renewal charges may occur within 24 hours before the end of the current period. You can manage or cancel renewal in your App Store or Google Play account settings. Refunds are handled by the store where the subscription was purchased.

Apple App Store purchases are also governed by Apple's standard end user license agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

Acceptable Use

Do not misuse the app, attempt to disrupt the service, upload unlawful content, reverse engineer the app, or use NutrientOS in a way that harms other users, the service, or third-party providers.

Privacy

Our Privacy Policy explains how NutrientOS collects, uses, and protects information. You can review it at /privacy.

Account Deletion

You can request account deletion through the app or at /delete-account. Deletion requests may require verification that you own the account.

Intellectual Property And Your Content

NutrientOS, including its software, design, text, and branding, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for your own personal, non-commercial use, subject to these terms.

You keep ownership of the content you submit, such as meal entries, photos, and notes. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, and display that content as needed to operate and improve the app and provide the features you use, including processing images and text through our AI service providers.

Disclaimer Of Warranties

The app is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure, or that any nutrition, fitness, or AI-generated information will be accurate or complete. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

Limitation Of Liability

To the maximum extent permitted by law, NutrientOS and its owners, operators, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the app, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for all claims relating to the app will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or twenty US dollars (US $20). Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless NutrientOS and its owners and operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the app, your violation of these terms, or your violation of any law or the rights of a third party.

Termination

We may suspend or terminate your access to the app at any time if you violate these terms, misuse the app, or where needed to protect the service or other users. You may stop using the app and delete your account at any time. Sections that by their nature should survive termination — including the disclaimers, limitation of liability, indemnification, intellectual property, and dispute resolution sections — will continue to apply.

Governing Law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Subject to the dispute resolution section below, any disputes not subject to arbitration will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction.

Dispute Resolution And Arbitration

Please read this section carefully — it affects your legal rights. Most concerns can be resolved by contacting us first at support@nutrientos.com, and you agree to try to resolve any dispute informally before filing a claim.

Any dispute, claim, or controversy arising out of or relating to these terms or the app that cannot be resolved informally will be settled by binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will take place in California or another mutually agreed location, and judgment on the award may be entered in any court with jurisdiction.

Class action and jury waiver: to the maximum extent permitted by law, disputes will be brought only in your individual capacity and not as a plaintiff or class member in any class, consolidated, or representative action, and you and we each waive any right to a jury trial. If this class-action waiver is found unenforceable for a particular claim, that claim will proceed in court rather than arbitration. You may opt out of this arbitration agreement within 30 days of first accepting these terms by emailing support@nutrientos.com with the subject line Arbitration Opt-Out.
